4. How We Use Your Personal Data
We will only use your personal data when the law allows us to. Most commonly, we use it under the following lawful bases:

  • Contractual Necessity: To register you as a new client, process property sales, manage a tenancy, coordinate maintenance, and collect rent.
  • Legal Obligation: To comply with regulatory requirements, including Right to Rent checks, Anti-Money Laundering (AML) checks, tenancy deposit protection, and HMRC reporting.
  • Legitimate Interests: To run our business smoothly, provide administration and IT services, and send relevant property market updates (provided your fundamental rights do not override these interests).
  • Consent: When you have explicitly opted in to receive direct third-party marketing.

5. Data Sharing and Third Parties
We may share your data with trusted third parties to fulfill our contractual and legal obligations:

  • Our Customer Relationship Management (CRM) software providers, who host and process client data securely on our behalf.
  • Tenant referencing agencies, credit reference agencies, and inventory clerks.
  • Approved contractors and maintenance teams (sharing only necessary contact details to arrange property repairs).
  • Tenancy deposit schemes to protect rental deposits.
  • Legal advisors, financial advisors, and utility providers (during change of tenancy).
  • Regulatory bodies (e.g., HMRC, the Information Commissioner's Office) to meet legal obligations.

6. Data Security and Retention
We have implemented appropriate security measures to prevent your data from being accidentally lost, used, accessed in an unauthorised way, altered, or disclosed. We retain personal data only for as long as necessary to fulfil the purposes we collected it for. By law, we must keep basic information about our clients (including Identity, Contact, Financial, and Transaction Data) for a minimum of five years for tax and AML purposes, and up to seven years for tenancy-related documents following the end of a lease.

Under UK data protection laws, you have rights regarding your personal data, including the right to:

  • Request access to your personal data (Subject Access Request).
  • Request correction of inaccurate data.
  • Request erasure of your data (where no overriding legal obligation dictates we must retain it).
  • Object to processing or request restriction of processing.
  • Withdraw consent at any time by contacting info@apbproperty.co.uk.
